(12) the Israelites again did what was offensive to GOD. And because they did what was offensive to GOD, GOD let King Eglon of Moab prevail over Israel. (13) [Eglon] brought the Ammonites and the Amalekites together under his command, and went and defeated Israel and occupied the City of Palms. (14) The Israelites were subject to King Eglon of Moab for eighteen years. (15) Then the Israelites cried out to GOD, and GOD raised up a champion for them: the Benjaminite Ehud son of Gera, a left-handed man. It happened that the Israelites sent tribute to King Eglon of Moab through him. (16) So Ehud made for himself a two-edged dagger, a gomed in length, which he girded on his right side under his cloak. (17) He presented the tribute to King Eglon of Moab. Now Eglon was a very stout man. (18) When [Ehud] had finished presenting the tribute, he dismissed the people who had conveyed the tribute. (19) But he himself returned from Pesilim, near Gilgal, and said, “Your Majesty, I have a secret message for you.” [Eglon] thereupon commanded, “Silence!” So all those in attendance left his presence; (20) and when Ehud approached him, he was sitting alone in his cool upper chamber. Ehud said, “I have a message for you from God”; whereupon he rose from his seat. (21) Reaching with his left hand, Ehud drew the dagger from his right side and drove it into Eglon’s belly. (22) The fat closed over the blade and the hilt went in after the blade—for he did not pull the dagger out of his belly—and the filth came out. (23) Stepping out into the vestibule, Ehud shut the doors of the upper chamber on him and locked them. (24) After he left, the courtiers returned. When they saw that the doors of the upper chamber were locked, they thought, “He must be relieving himself in the cool chamber.” (25) They waited a long time; and when he did not open the doors of the chamber, they took the key and opened them—and there their master was lying dead on the floor! (26) But Ehud had made good his escape while they delayed; he had passed Pesilim and escaped to Seirah. (27) When he got there, he had the ram’s horn sounded through the hill country of Ephraim, and all the Israelites descended with him from the hill country; and he took the lead. (28) “Follow me closely,” he said, “for GOD has delivered your enemies, the Moabites, into your hands.” They followed him down and seized the fords of the Jordan against the Moabites; they let no one cross. (29) On that occasion they slew about 10,000 Moabites; they were all robust and brave men, yet not one of them escaped. (30) On that day, Moab submitted to Israel; and the land was tranquil for eighty years.

It is taught in another baraita: The verse states: “If the sun is risen upon him, there shall be blood shed on his account.” A question may be raised: But did the sun rise only upon him? Rather, these words must be understood as follows: If the matter is as clear to you as the sun that the burglar is coming to you in peace, do not kill him. But if you are not sure about his intentions, arise and kill him. The Gemara notes a difficulty: The halakha in the undetermined case as stated in the first baraita contradicts the halakha in the undetermined case as stated in the second baraita. The first baraita indicates that if the homeowner is unsure about the burglar’s intentions, he is prohibited from killing the burglar, whereas the second baraita indicates that in such a case, he is permitted to kill the burglar.
A burglar who is found breaking into a house may be killed by the owner of the house with impunity (see Exodus 22:1). He too is sentenced on account of his ultimate end, as it is presumed that if the owner of the house would resist the burglar, the burglar would kill the owner of the house. If the burglar was breaking into a house, and in the course of doing so he broke a barrel, if there is blood-guiltiness for killing him, i.e., if the homeowner would be liable for killing him, the burglar is liable to pay for the value of the barrel. An example of this is if a father broke into his son’s house, in which case it is presumed that even if the son resists his father, his father would never kill him, and therefore the son may not kill his father, and if he does so he is liable. If there is no blood-guiltiness for killing him, i.e., if the homeowner would be exempt from punishment for killing him, the burglar is exempt from paying for the barrel.

With regard to one who steals a kasva, and one who curses with a sorcerer, and one who engages in intercourse with an Aramean woman, zealots strike him and kill him. Although the Torah does not say that one who performs one of these actions is liable to be executed, it is permitted for anyone who zealously takes the vengeance of the Lord to do so. In the case of a priest who performed the Temple service in a state of ritual impurity, his priestly brethren do not bring him to court for judgment; rather, the young men of the priesthood remove him from the Temple courtyard and pierce his skull with pieces of wood. In the case of a non-priest who performed the service in the Temple, Rabbi Akiva says: His execution is by strangulation, and the Rabbis say: He is not executed with a court-imposed death penalty; rather, he is liable to receive death at the hand of Heaven.

(1) In the seventh month, Ishmael son of Nethaniah son of Elishama, who was of royal descent and one of the king’s commanders, came with ten men to Gedaliah son of Ahikam at Mizpah; and they ate together there at Mizpah. (2) Then Ishmael son of Nethaniah and the ten men who were with him arose and struck down Gedaliah son of Ahikam son of Shaphan with the sword and killed him, because the king of Babylon had put him in charge of the land. (3) Ishmael also killed all the Judeans who were with him—with Gedaliah in Mizpah—and the Chaldean soldiers who were stationed there. (4) The second day after Gedaliah was killed, when no one else knew about it, (5) some men came from Shechem, Shiloh, and Samaria—eighty of them, their beards shaved, their garments torn, and their bodies gashed—carrying grain offerings and frankincense to present at the House of GOD. (6) Ishmael son of Nethaniah went out from Mizpah to meet them, weeping as he walked. As he met them, he said to them, “Come to Gedaliah son of Ahikam.” (7) When they came inside the town, Ishmael son of Nethaniah and the men who were with him slaughtered them [and threw their bodies] into a cistern. (8) But there were ten men among them who said to Ishmael, “Don’t kill us! We have stores hidden in a field—wheat, barley, oil, and honey.” So he stopped, and did not kill them along with their fellows.— (9) The cistern into which Ishmael threw all the corpses of the men he had killed in the affair of Gedaliah was the one that King Asa had constructed on account of King Baasha of Israel. That was the one which Ishmael son of Nethaniah filled with corpses.— (10) Ishmael carried off all the rest of the people who were in Mizpah, including the daughters of the king—all the people left in Mizpah, over whom Nebuzaradan, the chief of the guards, had appointed Gedaliah son of Ahikam. Ishmael son of Nethaniah carried them off, and set out to cross over to the Ammonites. (11) Johanan son of Kareah, and all the army officers with him, heard of all the crimes committed by Ishmael son of Nethaniah. (12) They took all their men and went to fight against Ishmael son of Nethaniah; and they encountered him by the great pool in Gibeon. (13) When all the people held by Ishmael saw Johanan son of Kareah and all the army officers with him, they were glad; (14) all the people whom Ishmael had carried off from Mizpah turned back and went over to Johanan son of Kareah. (15) But Ishmael son of Nethaniah escaped from Johanan with eight men, and went to the Ammonites.
